Terms and conditions (T&Cs)
Note: this English version is provided for accessibility. The legally binding text is the German version available at /de/agb.
1. Scope
These terms and conditions (T&Cs) apply to all services provided by UnitedIT (hereinafter "Provider") to its clients (hereinafter "Client"). The Client's differing conditions apply only if confirmed in writing.
2. Services
The subject matter comprises design, consulting, development, and operational services in the field of digital products (web apps, mobile apps, websites, visual branding, online marketing). The scope and specification of individual services are defined in a separate quotation or contract for work.
3. Quotes and contract formation
Quotations from the Provider are valid for 30 days from the date of issue, unless stated otherwise. The contract is formed upon written acceptance of the quotation by the Client.
4. Client cooperation
The Client shall provide all necessary information, content, access, and decision-makers in good time. Delays within the Client's area of responsibility entitle the Provider to postpone delivery dates accordingly.
5. Pricing and payment
All prices are in Swiss francs (CHF) plus statutory VAT. Invoices are due for payment within 30 days of the invoice date without deduction. In the event of late payment, default interest of 5 % p.a. applies.
6. Usage rights
Upon full payment of the agreed fee, the Client receives the rights to the delivered work result necessary for the contractually intended use. Rights to pre-existing components and standard libraries are reserved.
7. Warranty
The Provider warrants that the services delivered correspond to the contractually agreed specifications. Any defects must be reported in writing without delay, and at the latest within 30 days of acceptance.
8. Liability
The Provider is liable only for damages caused intentionally or through gross negligence by the Provider or its auxiliary persons. Liability for indirect damages and consequential damages (in particular loss of profit) is excluded to the extent permitted by law.
9. Confidentiality
Both parties undertake to keep confidential all confidential information received in the course of the collaboration. This obligation continues after termination of the contract.
10. Governing law and jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of the Provider.
11. Severability
Should individual provisions of these T&Cs be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
